CaseFlow AI – Privacy Policy
At Courtney Sessions, Inc. ("we," "our," or "us"), we are committed to protecting the privacy, security, and integrity of the data managed through our CaseFlow AI platform. This Privacy Policy explains how we collect, use, protect, and handle data when you use the CaseFlow AI system, particularly focusing on our free/standard version.
We built CaseFlow AI on the principles of Responsible AI, Transparency, and Accountability. We ensure that artificial intelligence enhances judicial and administrative workflows without compromising security or human oversight.
1. Information We Collect and Process
CaseFlow AI processes data solely to facilitate case management, document categorization, and automated judicial workflows. The types of data we collect and process include:
Authentication and Identity Data: To access CaseFlow AI, we collect necessary identity information. Our system utilizes Single Sign-On (SSO) and Multi-Factor Authentication (MFA) to verify users. We process data related to role-based access control (RBAC) to ensure users only see information relevant to their specific permissions (e.g., judge, counsel, clerk).
Operational, Usage, and Telemetry Data: We collect end-to-end telemetry and infrastructure data to maintain platform stability. This data is instrumented using OpenTelemetry (OTel) and includes system health, job latency, notice on-time rates, and performance metrics.
Audit Trail Data: We automatically log all access, modifications, workflow steps, and data transfers. These immutable audit logs include timestamps and user identification to provide a verifiable chain of custody and ensure total accountability.
Case and Document Data: When users upload documents, filings, and evidence, we process this unstructured and structured data to perform automated categorizations and generate summaries.
2. How We Use the Data
We strictly limit the use of the data we process. Your data is never used outside of its intended judicial or administrative mission.
Service Delivery: Data is used to automate repetitive tasks, coordinate workflows, and generate editable case memos.
System Monitoring and Observability: Telemetry data is used to power real-time dashboards so our administrators and leaders can monitor service quality, track system availability, and calculate the mean time to remediate any delivery failures.
Human-in-the-Loop AI Training: We use a "DataPrepOps" framework where AI model training and output generation are closely monitored by humans. Every AI-generated output requires human review and approval before becoming final.
Data Masking: Personally Identifiable Information (PII) is automatically masked or completely excluded during any model training or retraining processes to protect individual privacy.
Continuous Improvement: Retraining of our AI models takes place exclusively within secure, government-compliant environments, ensuring that any model evolution is traceable and explainable.
3. Data Sharing and Third-Party Subprocessors
We do not sell, rent, or trade your data. CaseFlow AI treats the client (e.g., the Court) as the exclusive data controller.
We engage third-party components to host our infrastructure and monitor system health. Specifically, telemetry data is published to observability tools like Honeycomb.io and CloudWatch. We use Honeycomb.io strictly to power operational dashboards and manage infrastructure health.
Important Data Privacy Guarantee: These third parties (including Honeycomb.io, AWS GovCloud, or Microsoft Azure Government) are contractually bound by strict security agreements aligned with NIST SP 800-53 controls. They do not store, process, or access any sensitive judicial, case, or client data.
4. Security, Encryption, and Access Controls
We employ a layered, defense-in-depth architecture to secure your data at every stage:
Encryption: All data is encrypted in transit using HTTPS and Transport Layer Security (TLS), ensuring data never traverses the public internet unsecured. Data at rest is encrypted using managed keys (AWS KMS or Azure Key Vault).
Zero-Trust Access: We enforce a Zero-Trust security model. Identity management is handled through secure federated access (AWS IAM Identity Center / Azure Active Directory), and conditional access policies restrict logins based on device compliance and location.
Network Isolation: CaseFlow AI operates within secure, segmented virtual networks (VPCs/VNets) with private endpoints, ensuring that production, development, and testing areas remain completely isolated.
5. Data Retention and Custodianship
You (the client) retain full ownership, control, and custodianship of all data, metadata, and outputs created within CaseFlow AI.
Retention and archival schedules are defined by your specific judicial, evidentiary, or institutional requirements.
We execute automated backup and deletion policies based strictly on your guidelines to ensure full data sovereignty.
6. Compliance
Our data handling practices are built to support the highest levels of compliance, including:
Alignment with NIST SP 800-53 Revision 5 and CJIS Security Policy standards.
Compliance with state-specific frameworks, such as the Texas Responsible AI Governance Act (TRAIGA), by guaranteeing transparency, explainability, and the prohibition of using AI for social scoring or unfair manipulation.
